PASSENGER TRANSPORT AMENDMENT REGULATIONS 2007 (S.R. 2007, NO. 72) - REG 5

Regulation 25A inserted

Before regulation 26 of the Principal Regulations , the following regulation is inserted in Part 5:

25A.     Prescribed circumstances for purposes of section 16V of Act

(1)  For the purposes of section 16V(1)(a) of the Act, the prescribed circumstances are the provision of community transport services.
(2)  In this regulation –
community transport service means a transport service provided by –
(a) an organisation –
(i) that is a not-for-profit organisation; and
(ii) that is funded entirely or partially by any of the following or a combination of any of the following:
(a) the Commonwealth;
(b) the State;
(c) a council; or
(b) an organisation that is, or is entitled to be, endorsed by the Australian Taxation Office as a charitable or benevolent institution; or
(c) a council.

These regulations are administered in the Department of Infrastructure, Energy and Resources.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Passenger Transport Regulations 2000 by –
(a) exempting, until 1 January 2009, small passenger vehicles used for the purpose of providing community transport services from the requirement to be registered as public passenger vehicles; and
(b) prescribing the circumstances in which the Transport Commission may exempt persons from the need to be accredited under Part 2A of the Passenger Transport Act 1997 .
